Terms and Conditions


1. Scope

The business relationship between Comazo GmbH + Co. KG (hereinafter referred to as Comazo) and the customer of the online shop (hereinafter referred to as the customer) shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order. Deviating terms and conditions and/or other conditions of the customer are expressly rejected, regardless of their designation, unless Comazo expressly agrees to their validity in writing.

The content provided on www.comazo.de and protect.comazo.de is intended for consumers whose habitual residence is in the Federal Republic of Germany, Austria, France, Italy, the Netherlands, Luxembourg or Belgium and who can provide a delivery address in that country. According to Section 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Comazo GmbH + Co. KG.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is German. We store the contract text and send you the order data and our Terms and Conditions by email. For security reasons, the contract text is no longer accessible via the internet.

4. Ordering Process

4.1

The presentation of products in the Comazo online shop merely constitutes an invitation to the customer to submit offers to conclude a purchase contract for the goods presented and therefore does not constitute a legally binding offer.

4.2

The customer can select products from the Comazo range and collect them in a so-called shopping cart via the “Add to shopping cart” button. If the customer clicks on the “Buy” button, they submit a binding offer to purchase the goods in the shopping cart.

4.3

If you would like to have your parcel delivered to a DHL parcel station, the payment method “purchase on invoice” is unfortunately excluded.

4.4

Before submitting the order, the customer can view and change the order data at any time using the “Shopping cart” button.

4.5

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking the “Buy” button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order, together with acceptance of the order, will be sent immediately after submission by an automated email. Upon receipt of this email confirmation, the purchase contract has been concluded.

We only deliver by shipping.

5. Delivery Conditions & Shipping Costs

5.1

We currently ship within Germany via DHL and to the following EU countries: Belgium, Bulgaria, Denmark, Estonia, Finland, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, the Czech Republic, Hungary, Cyprus, Austria and France. Please note that the Rhine islands in Germany cannot currently be supplied and, if necessary, please provide us with an alternative delivery address when placing your order. If you would like delivery to another foreign country, we will be happy to try to help you. If you have any questions, please send us an email at ecomazo(at)comazo.de.

Delivery to Switzerland:
For deliveries to Switzerland, we recommend the service of meinEinkauf.ch. meinEinkauf.ch will then handle all customs formalities and delivery to your door for a small fee. It is best to register directly here: MeinEinkauf.ch.
Please note: When purchasing via meinEinkauf, the payment method “purchase on invoice” is excluded.

5.2

As a rule, delivery is made by the shipping company DHL. Items are supplied only in quantities customary for households.

5.3

The shipping costs within Germany per order depend on the order value and currently amount to €0.00 including VAT.

For deliveries to EU countries, the shipping costs are currently as follows:

Austria: €9.95
France, Italy, the Netherlands, Luxembourg or Belgium: €9.95

For marketing purposes, we reserve the right to adjust shipping costs.

5.4

Delivery time is approximately 3–5 working days, depending on the availability of the items.

5.5

If not all ordered products are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.

5.6

If delivery of the goods fails despite three delivery attempts due to your fault, we may withdraw from the contract. In this case, we will inform you immediately. Any payments already made will be refunded to you without delay.

6. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

7. Warranty

If delivered items show obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the DHL employee delivering the goods. However, failure to make such a complaint has no consequences for your statutory claims. For all defects in the purchased item occurring during the statutory warranty period, you are entitled, at your choice, to the statutory claims for supplementary performance, defect rectification/replacement delivery and – if the statutory requirements are met – the further claims for reduction of the purchase price or withdrawal from the contract, as well as claims for damages, including damages in lieu of performance and reimbursement of futile expenses. Insofar as we grant you a seller’s guarantee, details are set out in the guarantee conditions enclosed with the respective delivered item. Guarantee claims exist without prejudice to statutory claims/rights. If supplementary performance has taken place by way of replacement delivery, the customer is obliged to return the goods originally delivered to Comazo at Comazo’s expense within 30 days. The return of the defective goods must take place in accordance with statutory provisions. Comazo reserves the right to claim damages under the conditions regulated by law.

8. Prices

The prices stated on www.comazo.de and protect.comazo.de are in euros and include statutory VAT.

9. Payment

The following payment methods are generally available in our shop. We use Mollie B.V. as our payment service provider.

9.1 PayPal

During the ordering process, you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is then carried out automatically by PayPal immediately afterwards. Further information will be provided during the ordering process.

9.2 Credit Card

By submitting the order, you simultaneously transmit your credit card details to us. After your authentication as the legitimate cardholder, we request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is carried out automatically by the credit card company and your credit card account is charged.

9.3 Advance Payment

If you choose advance payment, you will receive the bank details in a separate email after your order confirmation and we will deliver the goods after receipt of payment.

9.4 Klarna Invoice

With Klarna Invoice, you have the option of paying only after receiving your order. After completing the ordering process, the bank details and order details for a bank transfer will be displayed to you. Payment processing is carried out by our partner Klarna.

10. Retention of Title

The goods remain the property of Comazo GmbH + Co. KG until full payment has been made.

11. Warranty and Guarantees

The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.

13. Applicable Law, Place of Jurisdiction

13.1

The law of the Federal Republic of Germany shall apply to all legal transactions or other legal relationships with Comazo.

13.2

In business dealings with merchants and legal entities under public law, the place of jurisdiction for all legal disputes arising from these Terms and Conditions and individual contracts concluded under their validity, including actions relating to bills of exchange and cheques, shall be agreed as Comazo’s registered office (Albstadt).

14. Disclaimer for External Links

Comazo GmbH + Co. KG refers on its pages via links to other pages on the internet. Comazo expressly declares that it has no influence whatsoever on the design and content of the linked pages. Therefore, we hereby expressly distance ourselves from all content of all linked third-party pages on www.comazo.de and www.protect.comazo.de and do not adopt this content as our own. This declaration applies to all displayed links and to all content of the pages to which links lead.

15. Copyright and Trademark Law

The entire content of the homepage, in particular texts, graphics, photos, illustrations and software, is the property of Comazo. This content is protected by copyright and other industrial property rights. Reproduction, editing, storage or any other processing is not permitted.

All trademarks used on ww.protect.comazo.de are – unless otherwise stated – the property of Comazo. Any use of the trademarks in any form whatsoever without our consent is prohibited.

16. Image Rights

All image rights belong to Comazo GmbH + Co. KG or its partners. Use without express permission is not permitted.

17. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
